Terms of Use
The short version
- TightShip helps you organize inspections and repairs. It is not legal or regulatory advice, and it doesn't guarantee you'll pass any inspection.
- Your records are yours and stay on your device. Keep your own backups.
- The app is provided as it is. Our liability is limited, as described below.
- Disputes go to individual arbitration under California law.
1. Agreement
These terms are an agreement between you and QualiCore Consulting LLC, a California limited liability company ("QualiCore," "we," "us"). They cover the TightShip app on Android, iOS and the web, and the website at usetightship.com (together, "TightShip"). By using TightShip, you agree to these terms and to our Privacy Policy. If you don't agree, don't use TightShip.
You must be at least 18 to use TightShip. If you use it for a business or other organization, you confirm you are allowed to accept these terms on its behalf, and "you" includes that organization.
2. What TightShip is, and what it isn't
TightShip is a tool for walking a building, recording what needs fixing, tracking repairs and purchases, and producing reports. It includes checklists and, in places, references to laws and regulations to help you find the source material.
It is not legal, regulatory, engineering, fire-safety, or professional advice. Checklists and citations are summaries prepared for convenience. They may be incomplete, and regulations change. Always confirm requirements with the current official text and the agency that licenses you. Using TightShip does not mean a building is safe, compliant, or ready for any inspection, and it doesn't guarantee any result. You remain fully responsible for your buildings, your compliance, and your decisions.
TightShip is not an emergency tool. If you find an immediate danger, deal with it right away and call 911 or the right authority. Don't just log it.
3. Your records
Everything you enter into TightShip belongs to you. It stays on your device, and QualiCore doesn't receive it (see the Privacy Policy). That means:
- You are responsible for backups. If a device is lost, broken, or reset, or its storage is cleared, records without a backup are gone, and we cannot recover them.
- You are responsible for what you enter and share. Don't enter residents' names or health information. Don't photograph people without the permission the law requires. Only share exports with people entitled to see them.
4. Your license to use TightShip
We grant you a personal, non-exclusive, non-transferable, revocable license to use TightShip for your own or your organization's internal purposes, under these terms. You may not:
- Copy, modify, resell, rent, or redistribute TightShip, or offer it as a service to others
- Reverse engineer or decompile it, except where the law allows this despite this restriction
- Remove or change any copyright, trademark, or other notices
- Use TightShip to break the law, infringe anyone's rights, or harm anyone
Reports and files you export are yours to use and share. We keep all rights in TightShip itself, including the software, design, and checklists. TightShip, the TightShip logo, and "Run a tight ship" are trademarks of QualiCore Consulting LLC.
5. Price
TightShip is currently free. If we ever add paid features, we will show the price clearly before you are charged anything. Purchases made through the App Store or Google Play follow that store's payment and refund terms.
6. Feedback
We welcome ideas. If you send us suggestions, we may use them to improve TightShip without owing you anything, and without using your name unless you agree.
7. Updates and availability
We may update, change, or stop offering TightShip or any feature at any time. Because your records stay on your device, a change on our side never deletes them. Some updates may be required to keep using the app.
8. Disclaimers
TIGHTSHIP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, QUALICORE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT PROMISE THAT TIGHTSHIP WILL BE ERROR-FREE OR UNINTERRUPTED, THAT ITS CHECKLISTS OR CITATIONS ARE COMPLETE OR CURRENT, OR THAT DATA ON YOUR DEVICE WILL NEVER BE LOST.
9. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, QUALICORE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, CITATIONS, FINES, PENALTIES, OR LICENSING ACTIONS, ARISING FROM OR RELATED TO TIGHTSHIP, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO TIGHTSHIP IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR TIGHTSHIP IN THE 12 MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).
Some places don't allow certain disclaimers or limits. Where that's the case, they apply only as far as the law allows.
10. Your responsibility to us
If someone makes a claim against QualiCore because of how you used TightShip, what you entered or shared, or your breaking these terms or the law, you will cover QualiCore's reasonable losses and costs from that claim, including reasonable attorneys' fees.
11. Ending use
You may stop using TightShip at any time by deleting it. We may end your license if you break these terms. Sections 3, 4 (our rights), 6, 8, 9, 10, 12 and 14 continue after that.
12. Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
Try us first. Before starting any formal dispute, email admin@qualicoreconsult.com and give us 30 days to try to resolve it.
Binding arbitration and class waiver. Any dispute arising out of or relating to these terms or TightShip will be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, before a single arbitrator, in Sacramento County, California, or by video if both sides agree. You and QualiCore each give up the right to a jury trial and the right to bring or join a class, collective, or representative action.
Either side may instead bring an individual claim in small claims court if it qualifies. Either side may also go to court to stop misuse of its intellectual property. Any court case allowed under these terms must be brought in the state or federal courts in Sacramento County, California, and both sides agree to those courts' jurisdiction.
13. Apple and Google
If you got TightShip from the App Store or Google Play, these terms are between you and QualiCore only, not Apple or Google. QualiCore, not Apple or Google, is responsible for TightShip, its support, and any claims about it, including product liability, legal compliance, and intellectual property claims. Apple and Google have no duty to provide maintenance or support. If the app fails to meet a warranty that applies by law, you may notify Apple, and Apple may refund the purchase price, if any; Apple has no other warranty obligation. You confirm you are not located in a country under a U.S. government embargo and are not on any U.S. government list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use must also follow the store's own terms.
14. General
- Changes: We may update these terms. We'll post the new version here with a new effective date and, for significant changes, point it out in the app or on this site. Continuing to use TightShip after that means you accept the update.
- Entire agreement: These terms and the Privacy Policy are the whole agreement about TightShip. A separate signed agreement, such as a pilot agreement, controls where it conflicts with these terms.
- Severability: If part of these terms can't be enforced, the rest still applies.
- No waiver: Not enforcing a term right away doesn't mean we give it up.
- Assignment: You may not transfer these terms without our written consent. We may transfer them as part of a merger, acquisition, or sale of assets.
